ConvertScale

Terms of Service

Last updated: 16 October 2026

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and Конвърт Скейл ООД (trading as "ConvertScale"), a company incorporated in Bulgaria, European Union ("ConvertScale", "we", "us", "our").

By accessing or using our websites (convertscale.ai and flowscan.pro) and any services offered through them (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services.

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms. Material changes will be communicated via email or a notice on our websites.

2. Definitions

  • "FlowScan" — our post-click funnel diagnostic tool that scans publicly accessible websites and generates diagnostic reports, including the proprietary FlowScore metric.
  • "FlowScore" — a proprietary composite metric (0-100) developed by ConvertScale to evaluate post-click funnel health. FlowScore is not an industry standard, third-party benchmark, or guarantee of performance.
  • "Scan" — a single diagnostic analysis of a URL submitted by a User through the FlowScan service.
  • "Report" — the output generated by a Scan, which may include issue identification, scoring, recommendations, and AI-generated analysis.
  • "Paid Services" — any service requiring payment, including Deep Audit, Video Audit, and Strategy Session.
  • "Intake" — the optional data collection process where Users share marketing data (files, platform access, context) to enhance Paid Service delivery.

3. Eligibility

To use our Services, you must be at least 16 years of age (or the age of digital consent in your jurisdiction, whichever is higher). If you are using our Services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

You must provide accurate and truthful information when using our Services, including a valid email address and, where applicable, accurate company and website information.

4. Description of Services

4.1 Free FlowScan

You may submit a publicly accessible URL for a free diagnostic scan. The scan visits your website using an automated browser, extracts publicly visible signals, and generates a FlowScore along with a partial report. To access fuller results (Phase 2), you will be asked to provide your email address.

4.2 Deep Audit

A one-time purchase that unlocks the full detailed report for a completed Scan, including AI-generated analysis, prioritized recommendations, and estimated revenue impact. Pricing varies and is presented at checkout.

4.3 Video Audit

A premium one-time purchase. A ConvertScale analyst records a personalized video walkthrough (approximately 30 minutes) of your funnel diagnostic results, with specific prioritized recommendations. Delivered within 3-5 business days of purchase (or intake submission, whichever is later).

4.4 Strategy Session

A premium one-time purchase for a live 1-on-1 strategy consultation. Scheduling is done via Calendly after purchase. The session covers funnel review, analysis of submitted intake data, and strategic recommendations. Sessions are scheduled at mutually convenient times.

4.5 Intake Data Collection

For Paid Services, you may optionally submit marketing data (screenshots, CSV exports, platform access via OAuth, voice notes, video recordings) to enhance the depth and specificity of our analysis. All intake data is used exclusively for your service delivery.

4.6 FlowScan Orders

Each Paid Service bought on flowscan.pro is a Service Order. The deliverables of each tier are described on its upgrade and checkout pages at the time of purchase. A Service Order is charged once, in advance, through Stripe, at the price shown on the checkout page, under the pricing terms of Section 6.1. By completing checkout you authorise that one-off charge for the tier you selected.

Anyone holding an access link or token we send you can view the report or intake it belongs to, so keep it private. Sign-in links to a report that we email you stop working after 7 days, and intake links after 30 days. An expired report link takes you to a page where you can ask for a fresh one; for any other expired link, email [email protected].

5. Scanning and Acceptable Use

5.1 What the Scanner Does

FlowScan uses an automated browser (headless Chromium) to visit the URL you submit. It accesses only publicly available data — the same pages, scripts, stylesheets, and assets that any visitor would see. The scanner:

  • Loads the page and extracts HTML, CSS, JavaScript, and network request data
  • Analyzes page load performance, meta tags, structured data, and tracking scripts
  • Identifies diagnostic signals and matches them against our issue rule library
  • Identifies itself via a custom User-Agent string

5.2 What the Scanner Does Not Do

  • Access password-protected or authenticated areas
  • Submit forms, create accounts, or make purchases
  • Modify, delete, or write any data on the target website
  • Scrape personal data of the website's visitors or customers
  • Perform any destructive, denial-of-service, or penetration-testing actions
  • Bypass robots.txt directives for data extraction purposes

5.3 Authorization Requirement

Important

You must only submit URLs for domains that you own or for which you have explicit authorization to perform diagnostic analysis. By submitting a URL, you represent and warrant that you have the right to request a scan of that domain. ConvertScale is not liable for any claims arising from unauthorized scans you initiate.

5.4 Prohibited Uses

You agree not to:

  • Use the Services to scan domains you do not own or are not authorized to scan
  • Attempt to reverse-engineer, decompile, or extract the source code of our scanning engine, AI models, or issue rule library
  • Circumvent rate limits, access controls, or security measures
  • Use automated scripts, bots, or scrapers to access the Services without written permission
  • Resell, redistribute, or commercially exploit Reports or FlowScores without authorization
  • Use the Services for competitive intelligence gathering against ConvertScale
  • Submit malicious URLs designed to attack, exploit, or harm our infrastructure
  • Provide false or misleading information during registration, checkout, or intake
  • Interfere with the operation or security of the Services

6. Payments and Pricing

6.1 Pricing

All prices are displayed in USD and are exclusive of VAT; where VAT applies to you it is shown at checkout and on your receipt. Prices for Paid Services are one-time charges per scan or engagement — there are no recurring subscriptions.

We reserve the right to adjust pricing at any time. Price changes will not affect purchases already completed. We may run A/B tests on pricing, where different users may see different prices for the same service. A/B variant assignment is deterministic based on a non-reversible browser fingerprint hash and is consistent for the same user across visits.

6.2 Payment Processing

All payments are processed by Stripe, Inc., a PCI DSS Level 1 certified payment processor. We do not receive, process, or store your full payment card numbers. By making a purchase, you also agree to Stripe's Terms of Service.

6.3 Coupons and Promotions

We may offer promotional coupons or discounts from time to time. Coupons are subject to their specific terms, may have expiry dates or usage limits, and cannot be combined with other offers unless explicitly stated. We reserve the right to modify or discontinue any promotion at any time.

6.4 Credit Toward Upgrades

If you purchase a lower-tier service and subsequently wish to upgrade, the amount of your original purchase may be credited toward the higher-tier service. Credit amounts and eligibility are at our discretion and will be communicated at the time of upgrade.

7. Refund Policy

Digital Product Refund Policy

Our Reports and Video Audits are digital products that are generated and delivered electronically. Due to their nature, we generally cannot offer refunds once a Report has been unlocked or a Video Audit has been delivered. By purchasing, you acknowledge and agree that delivery of the digital product constitutes performance of the contract, and you expressly consent to this in accordance with EU consumer rights regulations (Directive 2011/83/EU, Article 16(m)). For a product delivered immediately, such as the Deep Audit, you ask for immediate delivery and confirm this at checkout before you pay.

7.1 Deep Audit

No refund once the full report has been unlocked and delivered. If our system fails to deliver a report due to a technical error on our side, we will either re-deliver the report or issue a full refund at your choice.

7.2 Video Audit

No refund once the video recording has been delivered. If we are unable to deliver the Video Audit within 10 business days of purchase (or intake submission), you may request a full refund.

7.3 Strategy Session

Full refund available if you cancel at least 24 hours before the scheduled session time. No refund for cancellations made less than 24 hours before the scheduled session or for no-shows. If we need to reschedule, we will offer alternative times. If no mutually acceptable time can be found within 30 days, you may request a full refund.

7.4 Failed or Short Delivery

If a technical failure on our side means we cannot deliver what you bought, you choose between re-delivery and a full refund. If a deliverable falls clearly short of what was promised at checkout, tell us and we will fix it, redo it, or refund it as appropriate.

7.5 Requesting a Refund

To request a refund, email [email protected] or [email protected] with your order details and reason for the request. We will process eligible refunds within 10 business days via the original payment method.

8. Intellectual Property

8.1 Our Intellectual Property

All content, code, designs, algorithms, issue rule libraries, scoring methodologies, AI models, prompts, the FlowScore metric, and any other proprietary technology or materials created by ConvertScale are and remain the exclusive intellectual property of ConvertScale. Nothing in these Terms grants you any ownership rights in our intellectual property.

8.2 Report License

When you receive a Report (free or paid), we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use that Report for your internal business purposes only. You may share a Report with your team members, contractors, or advisors who are working on the analyzed funnel.

You may not:

  • Resell, redistribute, or commercially exploit Reports
  • Use Reports to create competing products or services
  • Remove or modify ConvertScale branding, watermarks, or attribution from Reports
  • Publicly publish Reports in a way that misrepresents FlowScore as an industry standard

8.3 User Content

You retain ownership of any content you provide to us (intake files, voice notes, screenshots, etc.). By submitting content, you grant us a limited license to use it solely for the purpose of delivering the requested Service. We will not use your content for any other purpose without your consent, except as described in Section 9 regarding aggregated and anonymized data.

8.4 Video Audit Recordings

Video Audit recordings are created by ConvertScale and remain our intellectual property. You receive a license to view and use the recording for internal purposes. You may not publicly redistribute the recording without our written consent.

9. Aggregated Data and Product Improvement

We may use anonymized and aggregated data derived from Scans to improve our products, refine our diagnostic algorithms, train our scoring models, and develop industry benchmarks. This aggregated data does not identify individual users or specific businesses. Specifically:

  • Funnel intelligence records — anonymized signal patterns and issue frequencies are retained as aggregate data to improve diagnostic accuracy
  • Benchmarking — aggregate FlowScore data may be used to generate industry-level benchmarks and comparisons
  • Model improvement — patterns from scans may inform updates to our issue rule library and scoring algorithms

Your individual scan results, URLs, and business details are never shared publicly or with other users. See our Privacy Policy for full details on data handling.

10. Google Analytics Data Access

If you choose to connect your Google Analytics account via OAuth as part of the Intake process, the following terms apply:

  • We request only read-only access scopes necessary for funnel analysis
  • Your Google Analytics data is used exclusively for your Report and service delivery
  • We do not share your Google Analytics data with any third party
  • We do not store raw Google Analytics data permanently — it is accessed during analysis and discarded
  • You may revoke access at any time via your Google Account permissions
  • Our use complies with the Google API Services User Data Policy

11. AI-Generated Content

FlowScan uses artificial intelligence (via Azure OpenAI Service) to write parts of the diagnostic Report and to judge a few checks, such as design trust and offer clarity. The FlowScore itself is calculated from the results by fixed rules. You acknowledge and agree that:

  • AI outputs are probabilistic — recommendations are generated by AI models and may not be perfect, complete, or applicable in every situation
  • Not professional advice — AI-generated analysis does not constitute professional marketing, business, legal, or financial advice. You should exercise your own judgment and, where appropriate, consult qualified professionals
  • Revenue estimates are projections — any revenue impact estimates included in Reports are modeled projections based on available data and industry benchmarks. They are not guarantees of actual revenue outcomes
  • FlowScore is proprietary — the FlowScore is a ConvertScale-proprietary metric. It is not an industry standard, does not represent any third-party certification, and should not be interpreted as an absolute measure of website quality

12. Service Availability

We strive to maintain high availability of our Services but do not guarantee any specific uptime percentage or Service Level Agreement (SLA). The Services may be temporarily unavailable due to:

  • Planned maintenance and updates
  • Unplanned outages or technical issues
  • Third-party service disruptions (AWS, Stripe, Cloudflare, etc.)
  • Force majeure events

We will make reasonable efforts to restore service promptly and to notify users of any extended outages.

13. Rate Limiting and Access Controls

To ensure fair usage and protect our infrastructure, we may impose rate limits on the number of scans, API requests, or other actions a user can perform within a given period. We reserve the right to:

  • Rate-limit or throttle excessive usage
  • Temporarily or permanently suspend accounts engaging in abusive behavior
  • Refuse service to any user at our discretion, with notice where practicable
  • Block IP addresses or fingerprints associated with abuse

14. Disclaimer of Warranties

Important Legal Notice

To the maximum extent permitted by applicable law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis. ConvertScale makes no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, or non-infringement.

Specifically, we do not warrant that:

  • Reports will be error-free, complete, or achieve specific business outcomes
  • The Services will be available without interruption
  • FlowScore calculations will precisely reflect your funnel's actual performance
  • Revenue estimates will match actual revenue outcomes
  • AI-generated recommendations will be suitable for your specific situation
  • Our scanner will detect every possible issue on a given website

Nothing in these Terms excludes or limits mandatory consumer protection rights under EU law (including Directive 2011/83/EU and Directive 1999/44/EC) that cannot be waived by agreement.

15. Limitation of Liability

To the maximum extent permitted by applicable law:

  • No consequential damages — ConvertScale shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunity, arising from your use of or inability to use the Services
  • Aggregate cap — our total cumulative liability for all claims arising from or relating to these Terms or the Services shall not exceed the greater of (a) the amount you paid to ConvertScale in the 12 months preceding the claim, or (b) EUR 100
  • Scanning liability — ConvertScale is not liable for any consequences of scanning a website, including but not limited to claims from third parties whose websites you submitted for scanning without authorization
  • AI output liability — ConvertScale is not liable for any business decisions made based on AI-generated analysis, revenue estimates, or recommendations contained in Reports

These limitations apply regardless of the legal theory (contract, tort, strict liability, or otherwise). Mandatory statutory liability (e.g., for fraud, willful misconduct, or personal injury caused by negligence) cannot be excluded under EU/Bulgarian law and is not affected by this section.

16. Indemnification

You agree to indemnify and hold harmless ConvertScale, its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms
  • Your scanning of domains you are not authorized to scan
  • Your misuse of Reports or Service outputs
  • Your violation of any applicable law or third-party rights
  • Your provision of false or misleading information

17. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data. The Privacy Policy is incorporated into these Terms by reference. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

18. Email Communications

By providing your email address through any of our Services (including the FlowScan email gate, checkout, intake forms, or contact form), you may receive:

  • Transactional emails — scan reports, payment confirmations, service updates, and delivery notifications (required for service operation)
  • Marketing emails — educational content, promotional offers, and product updates (you may unsubscribe at any time via the one-click link in every email)

See our Privacy Policy for details on email marketing, unsubscribe mechanisms, and bounce handling.

19. Third-Party Services

Our Services integrate with third-party platforms including Stripe, Calendly, AWS, Azure OpenAI, and Cloudflare. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.

When you connect third-party accounts (e.g., Google Analytics via OAuth), you acknowledge that your use of those platforms is governed by their terms, and you are responsible for any data you share with us through those integrations.

20. Termination

20.1 By Us

We may suspend or terminate your access to the Services at any time, with or without cause, including but not limited to violation of these Terms, abusive behavior, fraudulent activity, or upon legal request. Where practicable, we will provide advance notice.

20.2 By You

You may stop using the Services at any time. If you wish to have your personal data deleted, see the GDPR erasure provisions in our Privacy Policy.

20.3 Effect of Termination

Upon termination, your right to use the Services ceases. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer, Limitation of Liability, Indemnification, and Governing Law) shall survive.

21. Governing Law and Dispute Resolution

21.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria and applicable European Union regulations. Where you are a consumer in the EU, you also benefit from any mandatory consumer protection provisions of the law of your country of residence.

21.2 Jurisdiction

Any disputes arising from or related to these Terms shall be submitted to the exclusive jurisdiction of the courts of Bulgaria, except where EU consumer protection regulations grant you the right to bring proceedings in your country of residence.

21.3 EU Online Dispute Resolution

In accordance with EU Regulation No. 524/2013, we inform you that the European Commission provides an Online Dispute Resolution (ODR) platform, accessible at https://ec.europa.eu/consumers/odr. We are not obligated to participate in dispute resolution proceedings before a consumer arbitration body, but may choose to do so on a case-by-case basis.

22. General Provisions

  • Entire Agreement — these Terms, together with the Privacy Policy, constitute the entire agreement between you and ConvertScale regarding the Services and supersede all prior agreements.
  • Severability — if any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver — failure by ConvertScale to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment — you may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
  • Force Majeure — ConvertScale shall not be liable for any failure or delay in performing obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, power failures, internet outages, or third-party service disruptions.
  • Headings — section headings are for convenience only and do not affect the interpretation of these Terms.
  • Language — these Terms are drafted in English. In the event of any conflict between the English version and any translation, the English version shall prevail.
